Administering Oaths

Do I need a notary license to swear in deponents?
No. According to Utah Code § 78A-2-404(2), "a certified court reporter is an officer of the court, authorized to administer oaths."

Can I swear deponents over Zoom?
Yes. See Administrative Order April 13, 2020.

How do I administer an oath?

Utah Code § 78B-1-143 states:

(1)An oath or affirmation in an action or proceeding may be administered in the following form:
    You do solemnly swear (or affirm) that the evidence you shall give in this issue (or matter) pending between ____ and ____ shall be the truth, the whole truth and nothing but the truth, so help you God (or, under the pains and penalties of perjury).

(2)The person swearing or affirming shall express assent when addressed.

Read and Sign

How long do witnesses have to read and sign depositions?
Utah State Depositions: Within 28 days according to URCP 30(e)
Federal Depositions: Within 30 days according to FRCP 30(e)(1)

Do parties have to ask for read and sign during the deposition?
Utah State Depositions: No. Witnesses may decide to sign and submit changes within 28 days after the transcript is completed. URCP 30(e)
Federal Depositions: Yes. Signature must be requested "by the deponent or a party before the deposition is completed." FRCP 30(e)(1)
